Bendzulla Actuarial Pty Ltd 
Bendzulla Actuarial Pty Ltd is the Fund’s Actuary and provides the following services to the Fund:
- calculation of the total contribution required from participating agencies for each self-insured risk;
- calculation of the proportion of the total contribution required from each participating agency;
- calculation of excess levels and appropriate discounts in contribution levels for optional higher excess levels;
- provision of reports on the administrative arrangements for the Fund and the calculation of agency contributions;
- attendance at meetings with agencies to discuss contributions where required; and
- provision of an annual report on the Fund’s performance as at 30 June each year, including estimating liabilities of the Fund.
Deloitte Touche Tohmatsu Deloitte Touche Tohmatsu is responsible for undertaking a review of the controls and processes that the Fund Administration Agent has in place for the management of claims of behalf of the Fund. The main aim of the review is to verify the figures used to compile the Financial Statements and to ensure that the Fund Administration Agent’s claims management controls and processes are in accordance with Australian Auditing Standards.

Government agencies 
Government agencies must ensure that employees are safe from injury and other health risks whilst at work in accordance with the requirements of the Workplace Health and Safety Act 1995.
Government agencies are also ultimately responsible for the management of claims and must instruct the Fund Administration Agent (Marsh Pty Ltd) and, where applicable, the Office of the Director of Public Prosecutions, regarding the management of those claims. This responsibility cannot be handed over to another entity.
Specific agency responsibilities regarding the management of incidents and claims are detailed under the relevant incident management section.
Government employees Government employees have a “duty of self care” and must also take reasonable care of the health and safety of other people, in accordance with the requirements of the Workplace Health and Safety Act 1995.
Government employees must also report any work-related injury or disease to their supervisor as soon as practicable (regardless of whether the employee intends to claim workers’ compensation) and report all other incidents to an appropriate agency officer.
Specific employee responsibilities regarding the reporting and management of incidents and claims are detailed under the relevant incident management section.
Marsh Pty Ltd Marsh Pty Ltd is the Fund Administration Agent. Marsh’s main responsibilities are to:
- provide claims administration for both insured and self-insured risks on behalf of, and in accordance with, the requests and directions of agencies. This includes file management, processing of payments and reimbursement of wages, collecting recoveries from third parties, investigating liability, managing disputes and estimating the cost of claims.
- review all claim and payment documentation to make sure that it is complete, accurate and appropriate. Marsh has the authority to refuse incomplete or incorrect claims for payment;
- provide claims management (but not legal) advice to agencies, either proactively or in response to a request by agencies (but it is the responsibility of agencies to decide whether to accept or reject the advice);
- provide regular reports to agencies on the progress, and actual and outstanding costs associated with each claim;
- report to Treasury and the Tasmanian Risk Management Fund Steering Committee as required;
- maintain a database (STARS) concerning all claims made by agencies that are covered by the Fund. The database must include actual costs incurred to date as well as estimated outstanding costs for each claim; and
- broker the purchase of external insurance cover, if required.
Office of the Director of Public Prosecutions The Office of the Director of Public Prosecutions (DPP) is exclusively responsible for providing legal advice on claims and provides legal representation in various courts and tribunals as required. The Office of the DPP is paid on a fee-for-service basis, in accordance with the requirements of Treasury Circular Memorandum No 5/00.
The Office of the DPP will arrange for external legal assistance if the DPP determines, in consultation with the agency, that it is required.
Tasmanian Risk Management Fund Steering Committee The Steering Committee is an inter-departmental committee with representatives from participating agencies. The Steering Committee serves as a consultative forum through which agencies can provide input into the operations of the Fund and feedback to Treasury, the Fund Administration Agent and Actuary.
The role of the Steering Committee is to:
- monitor the financial performance of the Fund;
- monitor the performance of the Fund Administration Agent;
- provide input on policies to improve the performance of the Fund and of agencies participating in the Fund;
- review and provide feedback on issues affecting members’ performance; and
- identify opportunities for agencies to collaborate on issues and share information.

Treasury Treasury provides secretariat and administrative support for the Fund and for the Steering Committee.
Treasury’s responsibilities include:
- managing the Fund Administration Agent Agreement, including conducting annual fee reviews;
- managing the Fund’s actuarial and accounting contracts;
- administering the financial aspects of the Fund, including determining and invoicing agency contributions and managing the placement of external insurance;
- providing advice to agencies on risks covered by the Fund; and
- reporting at both strategic and operational levels to all stakeholders involved with the Fund.
Workers Rehabilitation and Compensation Tribunal The Workers Rehabilitation and Compensation Tribunal hears all workers' compensation disputes. It has the status of a court of law. Information on the practices and procedures of the Tribunal is provided in the Workers Rehabilitation and Compensation Regulations 2001.
Workplace Standards Tasmania Workplace Standards Tasmania is responsible for administering the Workers Rehabilitation and Compensation Act 1988. It also investigates serious accidents and incidents as reported by employers in accordance with the requirements of the Workplace Health and Safety Act 1995.
